Actul normativ reglementeaz\u0103 m\u0103suri pentru protejarea \u0219i sprijinirea angaja\u021bilor, pe termen mediu \u0219i lung, care urmeaz\u0103 a beneficia pe deplin de drepturile salariale pe care le primesc, \u00een sensul achit\u0103rii contribu\u021biilor de asigur\u0103ri sociale la nivelul salariului real pe care \u00eel primesc din partea angajatorilor. Ini\u021biatorii \u0219i-au propus, prin aceast\u0103 OUG, potrivit Notei de fundamentare, descurajarea implic\u0103rii salaria\u021bilor \u00eencadra\u021bi cu timp par\u021bial \u00een activit\u0103\u021bi peste norma stabilit\u0103 prin contractele individuale de munc\u0103 cu timp par\u021bial, precum \u0219i plata diferen\u021belor corespunz\u0103toare nefiscalizate.<\/span><\/p>\n<p><span class=\"ugb-highlight\">Prin prevederile actului normativ se identific\u0103 \u0219i reglementeaz\u0103 p\u00e2rghiile juridice legale prin care pot fi amendate \u201ederapajele fiscale ale angajatorilor din perspectiva achit\u0103rii drepturilor ce le revin salaria\u021bilor, dar \u0219i a achit\u0103rii taxelor fiscale aferente bugetului de stat ce sunt stabilite \u00een sfera drepturilor salariale.<\/span><\/p>\n<p><span class=\"ugb-highlight\">Prin OUG nr. 117\/2021 se reglementeaz\u0103 urm\u0103toarele:\u00a0<strong>\u25aa<\/strong>\u00a0definirea, combaterea \u0219i sanc\u021bionarea \u201emuncii subdeclarate\u201d (munca subdeclarat\u0103 reprezint\u0103, \u00een sensul acestui act normativ, acordarea unui salariu net mai mare dec\u00e2t cel constituit \u0219i eviden\u021biat \u00een statele de plat\u0103 a salariilor \u0219i \u00een declara\u021bia lunar\u0103 privind obliga\u021biile de plat\u0103 a contribu\u021biilor sociale, impozitului pe venit \u0219i eviden\u021ba nominal\u0103 a persoanelor asigurate, transmis\u0103 autorit\u0103\u021bilor fiscale);\u00a0<strong>\u25aa\u00a0<\/strong>redefinirea \u0219i sanc\u021bionarea muncii nedeclarate prin primirea la munc\u0103 a unui salariat cu dep\u0103\u0219irea duratei timpului de munc\u0103 stabilit\u0103 \u00een cadrul contractelor individuale de munc\u0103 cu timp par\u021bial;\u00a0<strong>\u25aa\u00a0<\/strong>reglementarea drept contraven\u021bie a faptei de acordare a unor drepturi salariale net mai mari dec\u00e2t cele constituite \u0219i eviden\u021biate \u00een statele de plat\u0103 ale salaria\u021bilor;\u00a0<strong>\u25aa\u00a0<\/strong>reglementarea r\u0103spunderii \u00een lan\u021bul de subcontractare \u00een ceea ce prive\u0219te plata drepturilor salariale restante datorate salaria\u021bilor de c\u0103tre subcontractant.<\/span><\/p>\n<p><span class=\"ugb-highlight\">Cite\u0219te mai multe \u00een\u00a0<em><a href=\"https:\/\/www.ceccarbusinessmagazine.ro\/modificari-la-codul-muncii-s13031\/\" target=\"_blank\" rel=\"noreferrer noopener\">CECCAR Business Magazine<\/a><\/em>.<\/span><\/p>\n<\/div>\n<\/article>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"clear\"><\/div>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>\u00cen Monitorul Oficial nr. 951 din 5 octombrie 2021 a fost publicat\u0103\u00a0OUG nr. 117\/2021\u00a0pentru modificarea \u0219i completarea Legii nr. 53\/2003 \u2013 Codul muncii.
